“Organizations have to manage risk. Without risk, there’s no reward. Without employees, you don’t have much of a business. In order to mitigate this risk, employee backgrounds checks are vital.

In the last 10 years or so, there has been changes to the law, on how background checks should be used, and what information is reportable or not.  I highly recommend employers to hire an attorney that specializes in labor law, to develop standards of use for employee background checks.

Due to the current COVID situation, court records are currently not readily available. The new trend is to routinely conduct follow-up background checks on employees to make sure there was no changes in the record. The world has become increasingly volatile and uncertain.”

All around us we are now experiencing situations of civil unrest. In these uncertain times, businesses face new dangers from the riots and looting that have unfortunately accompanied some of the peaceful protests. We are now facing a crisis where law enforcement is either being defunded or disbanded.

The public is fearful about the uncertainty about how safe it is to go back to work. Employers need to begin planning now.  There are several issues that employers need to consider for protecting their employees during these situations.

Monitoring

The potential for threats to your staff and business are real. Organizations need to continuously monitor the news, social media, and reports from law enforcement on the potential for civil disobedience.

Screening

Employers are mandated to protect employees and customers in the workplace from any potential dangers. The Center for Disease Control (CDC) recommends that employers screen employees for temperature as a preliminary precaution to identify symptoms of the coronavirus. 

COVID-19 Testing

An individual with an elevated temperature should undergo standard novel coronavirus test. Workers with possible COVID-19 should work with their local and state health departments to coordinate testing through public health laboratories.

Workplace Requirements

Continued social distancing, expanded use of personal protective equipment, and other procedures must be strictly adhered to.

Communication

It is mission critical to establish a line of communication with your entire workforce. In times of crisis, communication needs to be consistent, clear and transparent. Fear and uncertainty: Lack of information can make staff feel the company is hiding something or isn’t being transparent.

We are all a little anxious about what safeguards will be in place as we phase back to work. No one wants to become infected and bring the virus home to our loved ones. It is equally important to provide information about the emotional health and financial resources that are available for the community.

Operations

Play it safe. Should a potentially dangerous situation arise, it is essential to make closing decisions as soon as possible. Employees need to know if they should come into work or if they need to leave immediately.

Protocols must be in place to instruct employees what to do during an emergency. Training should be ongoing and a part of the company culture to ensure the safety and well-being of the workforce.

  • Policies and procedures should include safeguards to offset any civil unrest within or outside the office.
  • Develop a virus prevention protocol that details what the communicable diseases policies are to prevent the spread of disease.
  • Disclosures must be clear that no job applicant or employee will be discriminated based on contracting a communicable disease. And that the employer will comply with statutes and regulations relating to the employee’s privacy.
  • Companies should consult with their labor and employment counsel about any legal issues that relate to the coronavirus and its impact on the workplace.
